Council Meeting
June 6, 2005

   The regular meeting of the Lyons Village Council was called to order Monday June 6, 2005 at 7:30 pm. Present: Mayor Mary Vroman, Dale Hallett, Fran Arquette, John Good, Julie Fenicle, Joan Klier, Village Employee Bob Iffland, Village Administrator Vicki Smith and Fiscal Officer Luann O’Hara.
    A motion was made and seconded to accept the minutes from the May 2 and May 16, 2005 meetings. 5 yea, motion passed.
A motion was made and seconded to accept the Bills for April 2005 and May 2005. 5 yea, motion passed.
    A motion was made and seconded to accept the Financial Reports from April 2005 and May 2005. 5 yea, motion passed.

Ziad Musallum - Fulton County Sanitary Engineer
    Ziad Musallum informed Council that he had met with Mrs. Kuhn and her land tenants to discuss the possibility of an easement on her property for the new water line from Ash Street to Barden Street. Ziad said it appeared as if she had no major objections. Ziad stated that she had valuable questions and concerns that need to be addressed. For example, she would want a fee for the contractors trespassing outside of the easement with machinery of $2.50 per foot per event. Ziad stated that this can be passed along to the contractors by writing it in the original contract. Mrs. Kuhns also wants $391 per acre for crop damage which would cover a three year period. Mrs. Kuhn’s tenants would like to be in attendance during the project to be sure that the tiles get repaired correctly and promptly. Ziad feels her questions and concerns can all be worked out. Ziad stated that he will be able to do the applications for loans or grants under our current contract with his office and the design and inspection of the project would be at an extra charge. Ziad presented Council with a list of loans and grants to study. Discussion on loans and grants available. Council asked that Ziad fill out a pre-application for a US EPA no interest loan. Dale Hallett asked if Ziad had contacted anyone about finding the water leak. Ziad stated that with PVC pipe the leak will be much harder to find in the area outside of the village. Ziad asked Bob to take water samples of all the creeks along the waterline from Wauseon to Lyons and test them for chlorine. If chlorine is present it could be a leak in the water line. Ziad will contact Aqua Line to set up a complete Village check of the waterlines for leaks.
    Ziad presented Council with a Sewer Capacity hand out. Ziad stated that the figures are based on an average household usage. Ziad stated that the sewer was designed for 65,000 gallons per day Council has designated a 20,000 gallon per day reserve. Ziad stated that based on this information the sewer has a 12,000 gallon per day surplus over and above the reserve and based on that the Village has approximately 93 taps available.
    Ziad informed Council that THOMA is prepared to proceed with the Telemetry installation and will contact the Village in about a week. 

Employees Report
    Bob Iffland informed Council that the Fulton County Engineers are not certain if they are going to remove the hill on County Road L as previously planned. Therefore the water line there may not need to be replaced.
    Bob stated that he and Rod had removed the playground equipment on the property from the Lyons School Building. All the playground equipment had mass amounts of concrete underground. Brian Burroughs broke up the concrete around the equipment so it could be moved; however the equipment got ruined in the process. Bob stated there was so much concrete they were unable to save the equipment.
    Bob stated that he repaired the rafters on the shelter at Green Park.
    Bob informed Council that as of June 1, 2005 all of the water meters were working. Bob stated that he is concerned the old meters are not working properly. Bob suggested that the low reading meters be replaced. Discussion on water meters. Council asked Bob to replace the low reading meters.

Committee Reports

Administrator’s Report
     Vicki informed Council that she had several updates from the previous meeting.
    Vicki stated that Ohio Gas will repair the hole on Cleveland Street.
    Vicki stated that Great Lakes Tank will repair the chipping paint on the bottom of the water tower.
    Vicki stated that A-1 Concrete will be back in mid June to pump up the driveways that have sunk free of charge.
    Vicki stated that Richard Patek will continue farming the land at the lagoon for $1425.
    Vicki informed Council that Mark Powers has been asked by the Prosecuting Attorney’s Office to follow up on the Kemp sewer tap issue. Vicki stated that Mark wants to get Ms. Kemp into court to find out why she will not hook up to the sewer but if she does not appear a warrant will be issued for her arrest.
    Vicki informed Council that the Village has received the Natureworks Grant that was applied for in 2003 for $7833. Vicki stated the grant needs to be used for playground equipment. Vicki asked Council who should administer the grant - her or the Park Board. Discussion. Council decided that the Park Board will administer the Grant. Bob stated that the restrooms at the ball park have not been cleaned since they were opened.
     Vicki asked if Council wants to change the Sub-Division Regulations on digging wells. Joan Klier stated that she has asked for information regarding this and will report at the next meeting.
     Vicki informed Council that the Historical Society wants the sidewalk fixed between the Village Hall and the Depot or they will block the drive. Vicki stated that Rod and Bob can fix it for approximately $100 in materials plus labor. Discussion. Council decided that Rod and Bob should fix the sidewalk.
    Vicki stated that an invitation was received from the Ohio Plan Insurance Company to the Toledo Mud Hens game on June 14, 2005 at 5:45 pm. Discussion. No one can make it to the game.
    Vicki informed Council that Joseph Morris is concerned his well is contaminated since his house burnt and would like Council to approve Village water under these circumstances. Discussion. Council asked Vicki to contact the Health Department to check Mr. Morris’s well for contamination.
    Vicki informed Council that Morenci , MI has a trained Zoning Inspector and asked if they were interested in hiring him for Village issues. Discussion. Council asked Vicki to contact the Morenci Zoning Inspector and ask him to attend the next meeting.
    Vicki stated she had been contacted by the Fulton County Engineers office concerning Fulton Street. It appears that in 1967 the north end of Fulton Street was vacated and now there is a 47 foot piece of property that it is unclear who the owner is. Discussion. A motion was made and seconded to make the 47 foot piece of property vacated by Fulton Street part of the Lyons Community Park. 5 yea, motion passed.
    Vicki informed Council that she has received complaints that a resident is parking his vehicles on the right of way on Ash Street and that the land tenants of that property are concerned they might hit them with their machinery. Discussion. Council asked Bob to find the right of way on Ash Street.

Mayor’s Report
    Nothing to report.

    Fran informed Council that there is a Basketball hoop sitting on the street on Kennedy Drive and asked who would be responsible if someone gets hit by a car. Discussion. Council asked Bob to talk to residents about moving basketball hoop.
    Dale Hallett asked if an invoice had been received from ARS on the All Garbage Pick Up Day. Vicki stated no. Julie Fenicle stated that Dave, the regular garbage pick up man for the Village is so polite and intelligent that it was a pleasure working with him. Discussion. Council asked that Vicki send ARS a thank you note for their help on garbage day.
    A motion was made and seconded to adjourn the meeting. 5 yea, motion passed. The meeting was adjourned at 9:12pm.
